Commissioners Demand Feds Reopen RS 2477 Roads

The Custer County Commissioners voted unanimously November 30 to accept findings of fact and to demand that the BLM and Forest Service reopen two closed roads in the East Fork of the Salmon River drainage the county says have valid rights of way across federal land under Revised Statute 2477.

Attorney Fred Kelly Grant acted as a hearing officer for the county at a June 8, 2011 public hearing to validate RS 2477 status for the two roads and issued findings of fact the commissioners accepted at their November 30 meeting.

The two roads are the West Pass Creek Road, commonly known as the East Fork Road in the upper part of that drainage, going south to the Custer-Blaine county line; and a section of Herd Creek Road above Herd Lake to an old BLM campground and a division fence between the Herd Creek and Sage Creek drainages, the latter in the Big Lost River watershed.

The county plans to notify SNRA, Sawtooth National Forest, and BLM officials by certified mail of the decision, with directions to remove any blockages and reopen the roads by April 15, 2012.
